Specific Details Assisted Decision-Making (Capacity) Act 2015 and Disability (Miscellaneous Provisions) Bill- delays in progressing

Intended results Safeguarding Ireland urges the full commencement in the first 6 months of 2019 of the Assisted Decision-Making (Capacity) Act 2015. However, it calls for the immediate commencement of Sections 3, Part 2 and Part 8. In addition, it asks that serious consideration be given to the include in Part 8 a ‘place of care’ decision to enable a person to express their will and preference with regard to where they wish to receive care in an AHD if that eventuality should arise. No further posponment of the Disability Miscellaneous Provisions Bill 2016 (2016 Bill)- scheduled to be considered by the Oireachtas Committee week commencing 17th December.
