IMO Submission on the General Scheme of Patient Safety Bill 2018
Intended results
1) to ensure the definition of patient safety incident excludes adverse events that are not the result of a patient safety incidents 2) to ensure mandatory reporting of patient safety events applies to providers and not individual practitioners who are already subject to sanctions by their statutory regulator
to review current procedures and prescribed statements for open disclosure under Part 4 of the Civil Liability (Amendment) Act 2017 to ensure that they are fit for purpose and do not negatively impact on the doctor-patient relationship and to ensure non-medical factors such as resource issues, understaffing, systems failures are included in the disclosure process.
to review the law in relation to gross negligence manslaughter
to ensure the notification of patient safety incidents and records created for the purpose of clinical audit are afforded the same protections as under the Part 4 of the Civil Liability (Amendment) Act 2017
to ensure HIQA’s remit should be extended to cover all private healthcare facilities
to ensure appropriate resources and supports are provided to implement the HSE’s open disclosure policy across the health services - not only in hospital services but across the health system including General Practice and community health services.
to ensure that management in hospitals and other designated services are subject to accountability in the same manner as the medical profession.
to give consideration to establishing a Medical Injuries Assessment Board (similar to the PIAB) to assess certain clinical negligence cases.
