Transposition of EU Directive on Unfair Trading Practices (UTPs) in the Food Supply Chain
Intended results
To highlight the urgency that is needed to transpose this EU Directive into Irish law with the imbalance that exists in the food supply chain.
That recongition needs to be given to the vulnerability of producers in the food supply chain
To put it on the record that IFA supports the "black"UTPs list - these are prohibited at all times, where they are in a written contract or not
To put it on the record that there are times that the "grey" list of UTPs are imposed on farmers by retailers / wholesalers and consequently cost them money. Farmers have not always agreed to participate / enter into a contract that provides for these, but are left with no choice if they want the retailer to buy their product.
The establishment by the Government of a visible and active Independent Retail Regulator would give confidence to suppliers that their complaints would be taken seriously and pursued.
Discretionary elements of the Directive - As provided for in the EU Directive, Member States can choose to go beyond the scope of the Directive. The Government should legislate to tackle other areas of unfairness by retailers, including: unsustainable discounting / below-cost selling by retailers, and annual tendering by retailers.
