Letter (2-5)
Sought an amendment to prevent an issue which arose when similar legislation was adopted in the UK. The UK's MIB was not defined as 'reasonably secure' under the legislation in their jurisdiction. This meant the MIB had to undertake extensive litigation to establish precedence, legal action which added to the costs passed to policyholders and delayed the payment of PPO compensation to the victims of uninsured drivers. The MIBI hoped to avoid a similar issue arising in this jurisdiction.
