Congratulations to the DHLGH staff on the progress of both the MAP and MPA Bill.
You are well aware of the requirement of an EIAR under the Habitats Directive when development is of sufficient scale. The Habitats Directive is terrestrial focused allowing for a definitive area for measuring impacts and mitigation. However, the marine is a more dynamic environment with 3 components of the surface, benthic and sea bottom.
Offshore Renewable Energy (ORE), has impacts on all three both vertically and laterally. Examples being, ocean dynamics of bird migration, fish migration, ocean currents for sedimentation/POC (particular organic carbon).
The development of ORE will need to assess the impact on MPAs – both designated and yet to be designated sites. The yet to be designated sites do represent a challenge in preparing EIARs, I attach a recent ruling by HC Judge Niamh Highland regarding the WFD.
