Recommendation offered: BPFI welcomes the growth increase of new applications for insolvency arrangements. BPFI expresses concern at the inclusion of further information in relation to expired protective certificates in the report under the ‘Creditor Acceptance / Rejection’ heading of ‘No’. It appears that in these cases, the Creditor has not voted on a proposal or that there was never a proposal brought forward by the PIP. We believe the table misrepresents the position of Creditors as they have not rejected a proposal as implied by the positioning of the ‘Protective Certificates expired’ row in the Outcome table on page 7. We also believe that the heading of the section should be amended to read ‘3. Outcome of Protective Certificate’ and that ‘Protective Certificates expired’ should be added as a third heading separate to the table on Creditor Acceptance / Rejection.
